The manufacturer may have made reasonable attempt to repair the defect with no avail.

Vicarious Liability

Vicarious liability applies when you give out or hire your car to another person. If they cause problems out of negligence, the law assumes that you are not responsible for the act. Vicarious liability helps car owners who are in the car hire business too, if in the time you have hired out the vehicle it gets involved in a wrong due to negligence or a criminal act, you won’t be liable.

Vicarious liability aims at excusing the owner of acts occurring when the vehicle is not in their hands unless his own negligence. For instance, giving out his car to an unlicensed person who goes on and commits a wrong when driving.
